1. Agreement Scope & Applicability
These Terms & Conditions govern all sports court engineering, civil construction, surfacing, repair, artificial turf installation, and supply of athletic equipment contracted with Kumar Sports (Head Office: Karma Road, Mahavir Nagar, Aurangabad, Bihar 824101). By engaging Kumar Sports for site evaluation, paying a booking deposit, or approving a Bill of Quantities (BOQ), the Client agrees to be bound by these provisions.
2. Quotations, BOQ & Price Validity
Written quotations, estimates, and BOQ schedules issued by Kumar Sports remain valid for 30 calendar days from issuance. Rates quoted reflect current raw material market prices (cement, steel, bitumen, imported synthetic acrylic resins, EPDM granules, and FIFA-grade monofilament artificial grass). Significant escalation in statutory taxes, transport logistics, or petroleum-based resin indices beyond the 30-day validity window may require rate revision prior to contract execution.
3. Milestone Payment Schedule & Advance Commitment
Unless mutually agreed in writing under a customized commercial tender, turnkey projects follow our standard progress-linked milestone framework:
- Milestone 1 — Mobilization / Booking Advance (30% to 40%): Due upon work order signing. Confirms slot booking, engineering site survey, CAD layout drafting, and factory batch allocation. (Note: As detailed in Clause 4 and our Return & Refund Policy, this booking amount is strictly non-refundable).
- Milestone 2 — Civil Sub-Base & Concrete Completion (30%): Due upon completion of earth excavation, WBM stone aggregate compaction, and casting of the PCC/VDF base slab.
- Milestone 3 — Material Delivery at Project Site (20%): Due upon physical arrival of specialized synthetic resins, turf rolls, rubber infill, and sports lighting fixtures at the site.
- Milestone 4 — Final Surfacing, Line Marking & Handover (10% to 20%): Due upon completion of multi-layer application, federation line markings, net/cage fitting, and joint site inspection.
4. Booking Advance Non-Refundability
The booking deposit paid to Kumar Sports is strictly non-refundable under all circumstances. This deposit immediately triggers civil engineering resource allocation, architectural CAD court design, soil survey scheduling, and non-cancellable factory procurement of custom-cut turf rolls and specialized pigment batches. 5. Client Site Readiness & Obligations
The Client is responsible for ensuring uninterrupted progress at the site by providing:
- Unobstructed Access: Motorable approach for civil machinery (dumpers, road rollers, transit mixers).
- Water & Electricity: Continuous clean water supply essential for mandatory 21-day concrete water curing, along with 3-phase electric power for scarifying and turf stitching equipment.
- Legal Clearances: Clear property title, demarcation of property lines, and required local municipal or society construction permissions.
- Site Security: Basic storage security for tools, synthetic chemical barrels, and equipment during the execution tenure.
6. Weather Conditions & Moisture Protocols
Professional synthetic acrylics, polyurethane (PU) cushion coats, and rubber bonding resins require strict application parameters: dry atmospheric conditions and concrete surface moisture content below 4%. Unfavorable weather events (such as monsoon rainfall, extreme dust storms, or standing condensation) necessitate temporary suspension of surfacing to safeguard against debonding. Such weather-related safety halts do not constitute contractor delay.
7. Warranty, Defect Liability & Surface Maintenance
Kumar Sports provides a 6 to 10-year technical warranty (specified in the project agreement) against surface blistering, delamination, and premature UV degradation. Warranty validity is contingent upon standard athletic facility care:
- Use of non-marking athletic sports footwear only on acrylic and PU surfaces.
- Prevention of hard-wheeled vehicles, sharp sports studs (on indoor acrylics), and unauthorized point loads.
- Periodic surface sweeping and adherence to our AMC (Annual Maintenance Contract) guidelines.
8. Dispute Resolution & Jurisdiction
Any disputes arising out of or related to contracts with Kumar Sports shall first be resolved through good-faith mediation. In the event of legal proceedings, the exclusive jurisdiction shall lie with the competent courts located in Aurangabad, Bihar, India.
